The Utah Lake Authority (“ULA”) holds the irrevocable right and permission to use photographs and/or video recordings taken of volunteers while participating in ULA activities on the ULA and other websites and in publications, promotional flyers, educational materials, derivative works, or for any other similar purpose without compensation. Such photographs and/or video recordings may be placed on the Internet. Volunteers may be identified by name in printed, Internet or broadcast information that might accompany the photographs and/or video recordings. Volunteers waive the right to approve the final product. All such portraits, pictures, photographs, video and audio recordings, and any reproductions thereof, and all plates, negatives, recording tape and digital files are and shall remain the property of the ULA. The ULA is hereby released its affiliates, sponsors and volunteers from any and all claims, demands, rights, promises, damages and liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation of likeness or defamation. Volunteers warrant that they are at least eighteen (18) years old and competent to contract in their own name or, if they are less than eighteen years old, that a parent or guardian has acknowledged this condition. This release is binding on volunteers and their heirs, assignees and personal representatives.
Liability Waiver
All volunteers with ULA voluntarily elect to participate in events. Activities adjacent to a body of water can be hazardous. During participation in Utah Lake Authority (ULA) Event, volunteers may encounter and/or be exposed to a variety of circumstances, hazards and risks, foreseen and unforeseen, many of which are inherent in each event. Volunteers assume all risk of injury and/or death associated with this Event and will not hold the Utah Lake Authority or any affiliates or sponsors liable for any circumstance related to this event. Volunteers must be in good physical condition and do not suffer from any disabilities or physical conditions that places them at risk or otherwise should prohibit the participation in the Event. Furthermore, in consideration of participation in this program volunteers release the Utah Lake Authority, its affiliates, sponsors and any other volunteers, from any and all claims, actions, demands, expenses liabilities (including reasonable attorney’s fees) and negligence made or brought by volunteers or those under volunteers’ care as a result of participation in the Event. Volunteers further agree not to sue the any of the officers, agents, affiliates, employees, contractors, or volunteers, as a result of any injury that might be suffered in connection with participation in the Event.
